ANY photo anyone takes and put on-line IS copyrighted..and its always legally wrong to take it and use it for your own profit..a photo doesnt have to say its copyrighted, to be copyrighted. but yeah..there isnt much that can be done about it.. if you put a photo on-line, you have to assume it can be "stolen" and used for purposes against your will. sad but true. in this case, the guy making the mugs absolutely has no right to use that photo, on his webpage, or on a mug, unless he specifically gets permission from Mike..the person who literally owns the photo, and owns the copyright to that photo, whether he said so or not.. People post sections of Toro copyrighted manuals on here all the time which violates the Toro copyright. Also, the site where the person got the image from violates the copyrights of Toro, Kohler, Briggs & Stratton, etc. many hundreds of times by hosting their copyrighted manuals so maybe the mug guy figured stealing from the much bigger thief wouldn't matter. It makes it hard to argue copyright infringement of the image when the source site promotes infringement by hosting the copyrighted manuals. I would imagine Toro, Kohler, etc. would prefer people go to their site so they can see new products and maybe buy them instead of somewhere else. I can see Toro, Kohler, etc. pursuing legal action more often than an individual. I believe the fines are based on each violation. Yikes! Are you a Copy Right Attorney or professional of some kind?
