Hammerhead 817 #1 Posted May 19, 2012 Hey I noticed a guy on Ebay selling coffee mugs with your name and text on it. It looks like he used Mikesrj pic of his RJ58 with front cutter bar. Does Mike know about that? Seller was over sea's.

neil 2,409 #4 Posted May 19, 2012 I think this guy is using Mikes pic as an example of what you can have printed on a coffee mug, In other words you can have a picture of your own tractor pr any pic that you like . I dont think his intention is to make profit out of Mikes picture, However he should have asked Mikes permission to use the pic and im sure with a polite email he would remove the pic. I had a couple of mugs printed up by this guy & found his stuff to be quite good. I did wonder myself when i also saw the pics being used if he had got permission to use them I had the front cover of my 704 and the exploded viiew printed on the mug so that i didnt get the my manual dirty and i use it as a handy refrence in the workshop he will put ANY picture that you want on these mugs and in know way am i promoting what he does this is just the knowledge that i have of this guy

Kelly 1,029 #6 Posted May 19, 2012 He probably does not even know it's Mikes tractor, just Google WH pics and see what comes up, I'm sure he just found a pic he liked and used it, and if it's on the web I'm sure it's legal to use it, unless stated other wise. stevasaurus 22,769 #7 Posted May 19, 2012 If it was one of my pictures, part of me would be flattered, and part of me would be like WTF. That is one great picture, and it was taken by a professional photographer.
Ken B 3,164 #8 Posted May 20, 2012 I'd be honored if someone did that with one of my Hore's. I'd try to get a free mug outta him though!

DoctorHfuhruhurr 137 #13 Posted May 20, 2012 Is that legal or did some body sneak one through? It's probably not copyrighted and even if it was pursuing it legally isn't practical.

sscotsman 148 #17 Posted May 21, 2012 and if it's on the web I'm sure it's legal to use it, unless stated other wise. wrong.. Is that legal or did some body sneak one through? It's probably not copyrighted and even if it was pursuing it legally isn't practical. wrong about not copyrighted, but right about "pursuing it legally isn't practical"! ANY photo anyone takes and put on-line IS copyrighted..and its always legally wrong to take it and use it for your own profit..a photo doesnt have to say its copyrighted, to be copyrighted. but yeah..there isnt much that can be done about it.. if you put a photo on-line, you have to assume it can be "stolen" and used for purposes against your will. sad but true. in this case, the guy making the mugs absolutely has no right to use that photo, on his webpage, or on a mug, unless he specifically gets permission from Mike..the person who literally owns the photo, and owns the copyright to that photo, whether he said so or not.. (and im sure he (the mug guy) knows it..which would make me not do buisness with him, because I know for a fact he is being dishonest) http://webnet77.com/webstuff/copyright.html Scot
boovuc 1,090 #18 Posted May 21, 2012 The last time anyone used a picture of my Wheelhorses was to show the US EPA I may be in violation of the Clean Air Act. The last time anyone used a picture of me was to show children who they should avoid talking to.
MikesRJ 552 #19 Posted May 21, 2012 By the way, the entire website from where they "stole" the picture is plainly copyrighted. That doesn't mean they care a hoot.

grnlark 487 #21 Posted May 22, 2012 If it was my tractor I think I'd be stoked! With regards to copyright for something like that - even if you agreed to a percentage of the profits, whats it really going to be at the end of the year? I doubt the guy is going to fund his house in Maui off of it. I'd be flattered. Great looking tractor and a great looking mug!
Hammerhead 817 #22 Posted May 22, 2012 Yes I figured this needed some attention, glad to hear from everybody! But it is a cool pic of a nice machine! Wahoooo! Keith
wheelhorse656 20 #23 Posted May 22, 2012 If it was me I would flattered but on the other hand I would or only email the guy and let him know he was using my photo.... Just to see if he would do the right thing and ask if I would like him go remove it in which case if he did I would tell him to keep it up.... If he got snobby about it I'd ask him to remove it. But really you wouldn't be able to make him any how if he was not polite...

People post sections of Toro copyrighted manuals on here all the time which violates the Toro copyright. Also, the site where the person got the image from violates the copyrights of Toro, Kohler, Briggs & Stratton, etc. many hundreds of times by hosting their copyrighted manuals so maybe the mug guy figured stealing from the much bigger thief wouldn't matter. It makes it hard to argue copyright infringement of the image when the source site promotes infringement by hosting the copyrighted manuals. I would imagine Toro, Kohler, etc. would prefer people go to their site so they can see new products and maybe buy them instead of somewhere else. I can see Toro, Kohler, etc. pursuing legal action more often than an individual. I believe the fines are based on each violation. Yikes!
MikesRJ 552 #25 Posted May 22, 2012 Perhaps your understanding of Copyright law is flawed.
